The Measures for Environmental Management of New Chemical Substances (hereinafter referred to as the Measures) was revised and adopted on December 30, 2009, and came into force on October 15, 2010. According to the Measures, before enterprises produce or import new chemical substances in China, they must first make a declaration of new chemical substances and receive a registration certificate for environmental management of new chemical substances before they can legally produce or import new chemical substances.

Requirements for filers

01.Domestic filers can handle the declaration of new chemical substances directly.

02. Overseas filers shall appoint an organization with the qualification of agent to handle the process. The agent shall assume all responsibilities and obligations of the holder of the registration certificate.

03. Overseas filers can only appoint one agent for the same type of new chemical substance to handle the same type of declaration.

Scope of Notification

Any chemical substance that is not included in the list of existing chemical substances in China will be regarded as a new chemical substance. The following substances, if they are new chemical substances, need to be declared as new chemical substances accordingly: raw materials or intermediates used in the production of pharmaceuticals, pesticides, veterinary medicines, cosmetics, food, food additives, etc.; surfactants, plasticizers, preservatives, dispersants and other intermediate products with specific functions or new chemical substances contained in products; variable-component substances, complex reaction products and other chemical substances that do not have, or cannot determine, a molecular structure and polymers, etc. Chemical substances and polymers with no or uncertain molecular structure, such as variable component substances, complex reaction products, etc.
The following substances are not applicable to the scope of new substance declaration and are exempted from declaration: 

(1) Manufactured products that are already managed by other laws and regulations;

(2) Naturally occurring substances;

(3) Non-commercial purpose or non-intentional production category;

(4) Other special categories: Ⅰ materials; Ⅱ alloys; Ⅲ non-separated intermediates; Ⅳ articles, etc.

New Chemical Substance Check

Any chemical substance not listed in the Inventory of Existing Chemical Substances in China (IECSC) (hereinafter referred to as the “Inventory”) is a new chemical substance. The declarant can confirm whether the substance to be declared is listed in the List by searching the List or by entrusting the IECSC to follow the procedure of new chemical substance search. If it is determined that the substance to be declared is included in the List, no new chemical substance declaration is required.

The List of Existing Chemical Substances in China is an updated version of the List of Existing Chemical Substances Produced or Imported in China, which was published to coincide with the implementation of the Measures for the Environmental Management of New Chemical Substances (Decree No. 17 of the relevant ministries and departments), and the scope of the List refers to the substances produced, imported or imported in China from January 1, 1992 to October 15, 2003 for commercial purposes, and which are already in China. The scope of inclusion refers to chemical substances that have been produced, processed, sold, used or imported from abroad for commercial purposes in China during the period from January 1, 1992 to October 15, 2003. Free Consultation: 13524733472 

The chemical substances included therein refer to any organic or inorganic substance with a specific molecular identity, including:

① Any compound of a substance or naturally occurring substance produced in whole or in part as a result of a chemical reaction; 

② Any element or non-chemical group of atoms.

Chemical substances include elements, compounds (including additives and impurities therein), byproducts, reaction intermediates, and polymers, but do not include mixtures, products (agents), and articles, nor do they include the following substances that are under the control of other relevant authorities:

① Pesticides (when produced, processed, imported or sold as pesticides);

② Tobacco and tobacco products;

③Radioactive substances;

④ Military products;

⑤ Food, food additives, medicine and cosmetics (when they are produced, processed, imported or sold as food, food additives, medicine, cosmetics, medicine or cosmetics respectively).

Scope of application of the type of declaration

Scientific filing declaration

1. For the purpose of scientific research, the annual production volume or import volume of new chemical substances is less than 0.1 tons;
2. Import of test samples of new chemical substances for the purpose of testing the ecotoxicological properties of new chemical substances in China with test organisms from China.

Simplified declaration of the basic circumstances of the annual production or import of new chemical substances less than 1 ton of special circumstances

1. Intermediates, and the annual production or import volume of less than 1 ton;
2. For export only, and the annual production volume is less than 1 ton;
3. Scientific research, and the annual production or import volume of more than 0.1 tons and less than 1 ton;
4. new chemical substance monomer content of less than 2% of the polymer or belong to the low concern polymers;
5. process and product research and development, and the annual production or import volume is less than 10 tons and not more than two years.

Series Declaration

Series declaration refers to the routine declaration of two or more series of new chemical substances with similar molecular structure, the same or similar use and similar test data as a whole by a single declarant, which is processed in accordance with the provisions of Article 15 of the Measures.

Joint Declaration

Joint notification refers to the routine notification processed in accordance with Article 15 of the Measures, where two or more notifiers submit a notification of a new chemical substance together at the same time.

Duplicate Notification

Repeated declaration refers to the routine declaration processed in accordance with the provisions of Article 15 of the Measures, based on the declaration of a new chemical substance or a series of new chemical substances submitted by the previous filer and the written authorization of the previous filer to consent to the use of the declared data in the subsequent filer's declaration materials by the latter.

Re-declaration of Increase in Registration Quantity

The declaration of increase in registration volume refers to the routine declaration that the holder of the registration certificate handles afresh in accordance with the provisions of Article 27 of the Measures when the holder of the registration certificate increases the registration volume and exceeds the original registration volume.

Re-declaration of change of registration use

Notification of change of registered use refers to the routine notification that the holder of the registration certificate for a new chemical substance in the hazardous category of key environmental management changes the use of the new chemical substance as recorded in the registration certificate, and that the holder of the registration certificate makes a new notification in accordance with the provisions of Article 27 of the “Measures”.

Report of new information

As stipulated in Article 26 of the Measures, when the holder of the registration certificate discovers a new hazardous characteristic of a registered new chemical substance, he/she shall immediately submit new information on the hazardous characteristic of the chemical substance to the Registration Center, and at the same time, do a good job of data retention and management.  

First-time situation and annual report

First-time status report

The holder of a registration certificate for routine declaration shall, in accordance with paragraph 1 of Article 35 of the Measures, submit to the Registration Center a report form on the first-time situation of a new chemical substance within 30 days of the occurrence of the first-time activity of the registration certificate for routine declaration.

Status report for each

Holders of registration certificates for new chemical substances in the hazardous category of key environmental management shall, in accordance with the provisions of Paragraph 2 of Article 35 of the Measures, report information on the flow of new chemical substances to the Registration Center within 30 days from the date of occurrence of each transfer to a different processing user after production or import.

Annual Report and Annual Plan

Annual Report for Simplified Declaration

According to Article 36 of the Measures, the holder of the registration certificate for simplified declaration shall submit the annual report for the previous year (January 1 to December 31) to the Registration Center by February 1 of each year.

Annual Report of New Chemical Substances in Hazardous Categories

The holder of the registration certificate for new chemical substances in the hazardous category (including new chemical substances in the hazardous category of key environmental management) shall submit the annual report for the previous year to the Registration Center. The annual report shall include at least the actual production or import, implementation of risk control measures, exposure and release in the environment, actual impacts on the environment and human health, and other information related to environmental risks.

Annual Plan for New Chemical Substances in the Hazardous Categories for Priority Environmental Management

Holders of registration certificates for new chemical substances in the hazardous category of key environmental management shall report, together with their annual reports, on their plans for the production or import of such new chemical substances in the current year as well as on their preparations for the implementation of risk control measures.
